Immigrant Visas I-130 form
American Consulate General of Guayaquil will accept petitions for immediate relative immigrant clasification from American citizens who are residents in our consular district for at least six months, including members of the U.S. armed forces. To demonstrate residency in a consular district, American Citizen petitioners must be able to show that they have permission to reside in the consular district and that they have been doing so continuously for at least six months before filing the petition. Individuals who are in the country on a temporary status, such as student or tourist, would not be considered to meet the residency standard. All lawful permanent residents, and American Citizens resident in the United States or with a permanent address in the United States, will file I-130 petitions at the USCIS Service Center having jurisdiction over their place of residence (as indicated on the USCIS website: http://www.uscis.gov/portal/site/uscis
INSTRUCTIONS TO FILE AN IMMIGRANT VISA PETITION (PLEASE READ ALL THE INSTRUCTIONS AND FOLLOW THEM THOROUGHLY)
A citizen of the United States can file the I-130 form to start an immigrant visa petition for a spouse, child (any age or civil state), parent, sibling, step-child (if the marriage took place before the step-child was 18 years old) and step-parent (if the marriage took place before the petitioner was 18 years old). The processing time varies depending on the category. All the required documents must be original. The forms will have to be printed clearly in black ink or typed. If an answer is not applicable respond N/A, do not leave blank spaces, if extra space is needed, include an extra sheet of paper with your name, indicating the number of the question you are referencing. All the forms must be fully completed. The petition must be filed with the DHS office or Embassy/Consulate having jurisdiction over the place of legal residence of the petitioner.
The petitioning process is a previous step to the process of the immigrant visa. All immigrant visas in Ecuador are processed in the American Consulate in Guayaquil. FORMS:
The forms are attached or you may access them on the web page (www.uscis.gov). One FORM I-130 by each beneficiary and a G-325 FORM by each spouse.
DOCUMENTS OF THE PETITIONER:
U.S. citizen by birth: current and expired passport, certificate of birth, CRBA, Ecuadorian visa, census and Ecuadorian identity card.
U.S. citizen by Naturalization: U.S. passport showing Ecuadorian entry stamps demonstrating dual nationality (DN), naturalization certificate. If the U.S. citizen has not traveled recently, enclose a Certificate of Migratory Movement with the last entrance and the nationality used when entering Ecuador.
Proof of residence: The petitioner will have to present a valid residence visa for Ecuador. DOCUMENTS ABOUT THE BENEFICIARY: IDENTITY CARDS: Inscription of birth, passport and/or identity card of each beneficiary. In addition to the following items:
IF YOU ARE FILING FOR PARENTS: Petitioner’s birth certificate showing the name of both parents.
IF YOU ARE FILING FOR STEP-PARENTS: Marriage certificate of step-parent to biological parent, divorce or death decrees (if applicable) of the parents.
IF YOU ARE FILING FOR SPOUSES: Marriage certificate, any divorce or death decrees for prior marriages. Two residence type photographs of each spouse, less than 30 days old.
IF YOU ARE FILING FOR CHILDREN: First you must contact American Citizens Services (ACS) at the 232-3570 ext. 227 or 228, and confirm if the child derives U.S. citizenship. ACS will issue a letter that needs to be attached to the petition stating whether the child is a U.S. citizen. If your son/daughter is married, include birth certificate of the spouse and his/her children, marriage certificate, divorce and death decrees for any previous marriages
IF YOU ARE FILING FOR MARRIED CHILDREN: Besides the documents mentioned in the previous paragraph, enclose the birth certificates of the spouse and children of your child, your child’s and his/her spouse’s divorce or death certificates for previous marriages.
IF YOU ARE FILING FOR SIBLINGS: Petitioner and beneficiary’s birth certificates (copy of the handwritten book of records), and your parents’ marriage certificate if they were married.
PROOF OF RELATIONSHIP: Present family, engagement, bachelor, marriage pictures, letters, etc. (All cases)
PICTURES: One picture for the petitioner and for each of the beneficiaries. The pictures must have been recently taken, 5X5 cm. The applicant's face on the photograph should measure 3.5 cm from the top of the head to the chin. The photographs must show the applicant's entire face on a white background. Applicants should not wear glasses or hats for the photographs. FEE: The fee for each petition is US$355.00 (Three hundred and fifty five US dollars, only cash accepted).
APPOINTMENTS: When you have all the required documents to file the petition please contact the Visa Information Service (VIS) at 1-800-010-145 in Ecuador, or 1-800-919-5290 in the United States, to schedule an appointment. For more information on the Visa Information Service, please click here. NO ONE WILL BE SERVED WITHOUT AN APPOINTMENT. The petitioner and the beneficiary/ies need to be present during the interview. IMPORTANT!!!! Every copy of birth, marriage, death or divorce inscriptions should be legalized by the Civil Registry and must be HANDWRITTEN. Typed or computerized forms ARE NOT ACCEPTED. In the event the record is unavailable, the Civil Registry will certify this with the appropriate explanation.
Every document not in English must be translated into the English language.
On the appointment date you must bring all the forms filled out, the pictures and all the documents required to file the petition(s). If you do not have all these requirements we will not be able to assist you.

The Consular Section is implementing new security procedures to speed interview processing. In order to minimize the amount of time applicants have to wait in line before their interview; the American Consulate General will prohibit applicants from entering the building with anything other than the documents they need for their application. Applicants should make arrangements before coming to the American Consulate General, so that the only things they have with them when they arrive are their documents. Purses, bags, suitcases, backpacks, etc. will no longer be permitted. Limited baby supplies will still be admitted.
